OLD LYME ZONING BOARD OF APPEALS
REGULAR MEETING
TUESDAY, NOVEMBER 19, 2013
MEMORIAL TOWN HALL, 52 LYME STREET
OLD LYME, CT - 7:30 P.M.

Present and voting were Judy McQuade, Vice Chairman, Mary Stone, Secretary, Kip Kotzan, regular member, Art Sibley, regular member and Karen Coniff, regular member

Present:  Laurie O’Brien, alternate, Harry Plaut, alternate and Kim Barrows, Clerk

Case 13-32A – 50 Shore Road, Janet Lage and Randy Nixon, appellants - Appeal of Zoning Enforcement Officer

A Motion was made by K. Kotzan, seconded by A. Sibley to DISMISS the appeal on the grounds that this is not an appealable decision that has been put forth by Ann Brown in a letter dated August 12, 2013.  Discussion:  J. McQuade stated that this is not an appealable decision, it was a statement; M. Stone stated in spite of the merits of the points made, the technicality is that was there a decision contained in that little paragraph and she didn’t think there was a decision on any new material in that little paragraph.  Great points were made, but it hinges on that letter.    No further discussion and a vote was taken:  In favor:  J. McQuade, K. Kotzan, A. Sibley, M. Stone, K. Coniff   Opposed:  None   Abstaining:  None   The motion passed unanimously 5-0-0

Case 13-33 – Mark Brett & Matthew Fleischer, 458 Shore Road

A Motion was made by K. Kotzan, seconded by A. Sibley to GRANT the necessary variances to allow construction of an enclosed three-season porch and a second story deck as an addition to existing building as depicted on plans entitled “Site Development Plan property of Mark J. Brett & Matthew B. Fleisher 458 Shore Road – Conn. Route 156 Old Lyme Connecticut Dated May 13, 2005, Scale: 1” = 20’, Sheet 1 of 1 revised 6/9/05, 6/5/06, 6/8/06, 5/23/13, 8/5/13, 8/19/13, 9/3/13 and 10/1/13 prop porch and deck”     with the condition that the three-season room will not be heated.  The reason to grant was that as an addition to an already approved plan, varying the regulation for floor area seems reasonable in this situation given the mixed use of the property.  No further discussion and a vote was taken:  In favor:  J. McQuade, K. Kotzan, K. Coniff, A. Sibley  Opposed:  M. Stone  Abstaining:  None   The Motion passed 4-1-0

New Business

A letter from Stephen Mortimer of the 26 Sea View Trust, LLC dated October 18, 2013 requesting a two year extension to commence work at property located at 26 Sea View Road.  Variances were granted in June of 2012 to allow demolition of existing dwelling and construct new house attached to existing garage.  The Board discussed the request and granted a one year extension from February 1, 2014 to February 1, 2015.  

A Motion was made by A.  Sibley, seconded by K. Kotzan to grant a one year nonrenewable extension on the variances as previously granted.  No discussion and a vote was taken:  In favor:  J. McQuade, K. Kotzan, K. Coniff, A. Sibley  Opposed:  M. Stone  Abstaining:  None   The Motion passed 4-1-0

Old Business

The Board discussed a request to change the roofline on the garage at 25 Sargent Road where variances were granted in June of 2013.  The new proposal was submitted to the members at the meeting along with the proposal that was originally approved.  

A Motion was made by M. Stone, seconded by A.  Sibley to approve the change to the roofline as presented since this is a reasonable change which improves the appearance and functionality of the building without an increase in the footprint.  No discussion and a vote was taken:  In favor:  J. McQuade, K. Kotzan, A. Sibley, M. Stone, K. Coniff   Opposed:  None   Abstaining:  None  The motion passed unanimously 5-0-0

Adjournment

A Motion was made by K. Kotzan, seconded by R. Smith to adjourn the November 19, 2013 Regular Meeting; no discussion and a vote was taken.  The motion to adjourn passed unanimously.  5-0-0    The meeting adjourned at 9:18 p.m.
